1. Accounts and Registration

However, by using the Service, you grant Miraitech a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your User Content solely for the purpose of providing and improving the Service (e.g., generating search results or AI summaries for you).

3. Acceptable Use and Restrictions

You agree not to use the Service:

1. In any way that violates any applicable national or international law or regulation.
2. To exploit, harm, or attempt to exploit or harm minors in any way.
3. To transmit any unsolicited or unauthorized advertising (spam).
4. To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
5. To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.

Additionally, you agree not to:

4. Artificial Intelligence Disclaimer

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

6. Limitation of Liability

6.1 General Limitation

To the maximum extent permitted by applicable law, in no event shall Miraitech, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this Service.

6.2 For Australian Users (Australian Consumer Law)

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy implied or imposed by any legislation which cannot lawfully be excluded or limited, including the Australian Consumer Law (ACL) set out in the Competition and Consumer Act 2010 (Cth). If a guarantee under the ACL applies to the Service, our liability is limited to the resupply of the services or the payment of the cost of having the services supplied again.

7. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Miraitech does not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components.

8. Governing Law

8.1 Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions.

8.2 Dispute Resolution

If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting the Company.

9. Specific Local Provisions

9.1 United States (DMCA Notice)

If you are a copyright owner or an agent thereof and believe that any content on the Service infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the necessary information in writing to admin.services@miraitech.com.au.
